What Marks are registerable? |

|
To determine if a Mark is federally registerable, we first typically consider whether the mark is improperly descriptive of the goods and/or services with which it is used. If not improperly descriptive, we order a Registerability Search from a professional Mark searcher. We evaluate the results of the Registerability Search to determine whether the mark is unique enough to qualify for registration. To be "unique enough", use of the Mark must not create a "likelihood of confusion" with another's Mark regarding the origin of the goods/services. If it does, we might try to encourage you to adopt a different Mark to avoid the potential for an infringement challenge or suit. |
